1. Acceptance of Terms

By downloading, installing, or using the HockeyVision mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and HockeyVision ("we," "us," or "our").

2. Description of Service

HockeyVision is an iOS application that uses spatial audio cues delivered through Apple AirPods and head-tracking motion data to help hockey players train their awareness and develop the habit of keeping their head up while stickhandling. The App provides audio-based training drills, real-time feedback, and post-drill performance analytics.

3. Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the App, you represent and warrant that you meet these eligibility requirements.

4. Device and Equipment Requirements

The App requires a compatible iPhone and Apple AirPods (or AirPods Pro) with head-tracking capabilities. You are solely responsible for obtaining and maintaining all devices, equipment, and internet connections needed to access and use the App. We are not responsible for the unavailability of the App due to device incompatibility or connectivity issues.

5. User Accounts

Certain features of the App may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

6. Acceptable Use

You agree to use the App only for its intended purpose of hockey training and personal skill development. You shall not:

  • Reverse engineer, decompile, or disassemble the App
  • Modify, adapt, or create derivative works based on the App
  • Use the App for any unlawful or unauthorized purpose
  • Attempt to gain unauthorized access to the App's systems or networks
  • Remove or alter any proprietary notices or labels on the App
  • Redistribute, sublicense, or resell access to the App

7. Intellectual Property

All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, audio clips, software, and the overall design — are the exclusive property of HockeyVision and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

8. Health and Safety Disclaimer

HockeyVision is a training aid and is not a substitute for professional coaching, medical advice, or athletic instruction. You acknowledge and agree that:

  • You use the App at your own risk and are solely responsible for your physical safety during training
  • You should consult a physician before beginning any new exercise or training program
  • Using headphones or earbuds during physical activity may reduce your awareness of your surroundings
  • We are not liable for any injury, loss, or damage resulting from the use of the App

9. Subscriptions and Payments

Certain features of the App may be available through paid subscriptions or one-time purchases processed through the Apple App Store. All payments are subject to Apple's terms and conditions. We do not directly process payments. Subscription terms, pricing, and renewal policies are presented within the App at the time of purchase.

10. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease. You may also terminate your use of the App at any time by deleting it from your device.

11. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOCKEYVISION AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.

13. Indemnification

You agree to indemnify, defend, and hold harmless HockeyVision and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the App or your violation of these Terms.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by other means. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
